Terms of Sale

1. Seller

These Terms of Sale govern purchases of the MagicCards Pro subscription concluded between:

and any individual making a purchase on magic-cards.fr (the "Customer").

2. Products and services

MagicCards offers a digital subscription (Pro plan) providing access to advanced features of the flashcard service: AI-powered deck generation, unlimited decks, priority access to new features.

The service is available immediately upon payment confirmation.

3. Pricing

Prices are displayed in euros, inclusive of all applicable taxes.

The Seller is a micro-entrepreneur exempt from VAT under French law (Article 293 B of the General Tax Code). No VAT applies to sales. Payment receipts include the mention "TVA non applicable — art. 293 B du CGI."

Current prices are those shown on the Pricing page at the time of subscription. The Seller reserves the right to modify prices at any time with at least 30 days' prior notice.

4. Payment

Payment is made online via Stripe, a secure payment provider. The Customer can pay by credit card (Visa, Mastercard, American Express) or any other method offered by Stripe.

No banking data is stored on MagicCards servers. Payment is charged at the time of subscription, then automatically renewed at each billing period (monthly or annual).

5. Right of withdrawal

In accordance with applicable consumer protection law, the right of withdrawal does not apply to digital content where execution has begun with the consumer's prior agreement and express waiver of withdrawal rights.

By subscribing to the Pro plan and accessing features immediately, the Customer expressly waives their right of withdrawal.

For exceptional refund requests, contact us at contact@magic-cards.fr. Each request is reviewed on a case-by-case basis.

6. Duration and renewal

The subscription is taken out for a period of one month or one year depending on the chosen plan. It renews automatically at the end of each period for the same duration and at the same price, unless cancelled beforehand.

For annual subscriptions, the Customer is notified of the renewal at least 7 days before the billing date.

7. Cancellation

The Customer may cancel their subscription at any time from their Profile page (under "Manage my subscription") or by contacting contact@magic-cards.fr.

Cancellation takes effect at the end of the current billing period. No pro-rata refund is issued for the remaining period, except in exceptional cases at the Seller's discretion.

After cancellation, the account automatically reverts to the free plan and Pro features are no longer accessible.

8. Service availability

The Seller strives to ensure 24/7 service availability. Interruptions may occur for maintenance, updates, or force majeure.

The Seller shall not be liable for service interruptions beyond its control, including those related to third-party infrastructure (Vercel, Firebase, Stripe).

9. Liability

The Seller's liability may only be engaged in case of proven fault. In any event, the Seller's liability is limited to the amounts actually paid by the Customer in the last 12 months.

10. Disputes and mediation

In case of dispute, the Customer may contact the Seller at contact@magic-cards.fr to seek an amicable resolution.

Failing an amicable agreement, the Customer may use the European online dispute resolution platform at ec.europa.eu/consumers/odr.

As a last resort, French courts shall have exclusive jurisdiction. These Terms of Sale are governed by French law.
